From time to time, Mola may make changes, additions or modifications to its Privacy Statement for various reasons. The most up-to-date version is always available on our website.

 

General

So that we can properly carry out our commercial activities, it is sometimes necessary to process personal data from our visitors and from other relationships. This Privacy Statement describes why we process your data, how we do it and what your rights are in relation to that (such as your right to access and your right to object to the processing of your data).

If you visit Mola, we will ask you about possible infectious diseases. For this purpose you sign the health declaration. We process this information subsequently in order to comply with the food safety regulations which apply to our sector – International Food Standard (IFS). We process this data only if we have your consent; however, if you do not give your consent, we may have to refuse you access to our premises.

Why do we process your data? Internal checking, company security and compliance with the food safety regulations (IFS) which apply to our sector. For service purposes to track your message and inform you about the next steps This personal data is processed in order to assess your suitability and availability for temporary or permanent vacancies which are open in Mola, whereby use can also be made of reference checks, social media or test results (if this is relevant to the job role and was specified in the vacancy description).
Why might we use your personal data? The use of your personal data is necessary to promote the legitimate interest of Mola or third parties. That legitimate interest is Mola’s interest in protecting our property and complying with the sector’s applicable regulations. We only process the data relating to infectious diseases (health declaration) with your consent. You can revoke this consent at any time. The promotion of our legitimate interest in being able to provide our services as efficiently as possible to our website visitors. The use of your personal data is necessary to promote the legitimate interest of Mola. This is in order to assess your suitability for working at Mola.
Who has access to your data? Only Mola employees who need the personal data to carry out their work will have direct access to your data. How long do we keep your data? We keep your contact details for a maximum of one year after you have visited Mola. We keep your health declaration for as long as necessary to comply with our audit obligations. This is one year as well. If after this phase it results in an actual commencement of employment, then this data will be used and kept in relation to that commencement.

In all other situations the data will be deleted within four weeks of your response unless explicit consent to retain the data is given by the candidate.

Do I have to provide this data to Mola? It is necessary to process this personal data if you want to have access to Mola’s premises. Without this data we are unable to grant you access. It is necessary to process this personal data if you want Mola to get in contact with you. We cannot contact you without this data. It is necessary to process this personal data to verify your suitability for a possible job role at Mola. Without this data we cannot deal with your application.

What about the use of my data by third parties?

Mola has put in place agreements with all the parties to whom we provide your personal data to adequately ensure the careful processing of your personal data in accordance with the law and Mola’s internal privacy policy and this external Privacy Statement.

If we provide access to your data to third parties, we do this only when we are certain that the third party will only use the data in a manner and for a purpose which is related to the purpose for which we obtained the data, and solely in accordance with this Privacy Statement. Furthermore, the legally required confidentiality obligations and security measures to prevent your personal data from becoming known to other parties always apply.

In some cases, we have to provide data to third parties, such as the judicial authorities, because it is a legal obligation. In so doing, we always seek to respect your privacy as far as we possibly can.

If we want to pass your data outside Europe, for example because a data centre or our supplier is domiciled there, we will only do this under the conditions set by the law, e.g. by means of a contract to which the EU Model Clauses apply.

How do we protect your personal data?

We take all reasonable and appropriate security measures to protect our visitors and participants against unlawful access or modification, disclosure or destruction of personal data. In this regard we comply with the applicable security standards.

If despite the security measures there is a security incident which has probable adverse consequences for your privacy, we will inform you about the incident as quickly as possible. We will also inform you as to the measures we have taken to limit the consequences and prevent future repetition.

What are your rights regarding the use of your personal data (and how can you exercise them)?

  • You can register an objection to the use of your personal data, for example where you consider that the use of your personal data is unnecessary for the performance of our activities or for compliance with a legal obligation.
  • You have the right to access your personal data. This means that you can query which of your personal data has been registered and for which purposes it is being used.
  • If you identify that we have incorrect personal data about you, then you can have this personal data rectified. You can also request that we restrict the processing of your personal data in general, or for the period we need in order to assess your requests or objections.
  • You can also request us to remove your personal data from our systems. You can also request us to arrange for your personal data to be transferred to another party.
  • We will comply with your request, unless we have a compelling, legitimate interest in not deleting the data that outweighs your privacy interest. If we have removed the data, we will not be able to immediately remove all copies of the data from our systems and backup systems due to technical reasons. We can refuse to comply with the aforementioned requests if these are made unreasonably often, demand unreasonably onerous technical efforts or have unreasonably onerous technical consequences for our systems or endanger the privacy of others.
  • You can submit the aforementioned requests or register the mentioned objection by sending a letter incorporating your name, address, telephone number and a copy of a valid proof of identity to hr@molan.nl. Do not forget to render unreadable your BSN on the copy of the proof of identity before you send it in. You will receive a reply within a month.

Do you place cookies if I visit your website?

Our website tracks general visitor information, such as the most frequently visited pages. The purpose of this is to optimize the layout of the website for you. The information can also be used to offer more focused information. None of your personal data is ever sent/recorded via the Internet without obtaining your consent to that.

Cookies are placed on Mola’s website. Cookies are simple text files containing information which your browser stores on your computer, tablet or smart phone. The website instructs the browser you use for viewing websites (e.g. Internet Explorer or Google Chrome) to save these cookies on your computer. A cookie does not contain any identifying data and is only applied to make it easier for you to use the Mola site. If you are not concerned about ease of use, you can block the use of cookies via your web browser (e.g. Internet Explorer or Firefox). Most parts of our website will remain readable.

Mola makes use of two cookie types:

What is your internal policy for handling my personal data?

When we process personal data, we always do so carefully and in accordance with the law and our Privacy Policy.

For this purpose, Mola has drawn up an internal Privacy Statement ‘How we handle Personal Data at Mola’. Every employee is able to view this at any time at Mijn Mola.

The basic principles of our Privacy Policy are:

  • We always tell you what we are doing with your data.
  • We use the data only for the purpose for which we collected it.
  • We collect, use and store no more data than is necessary for us to achieve the purpose for which we obtained the data.
  • We collect, use and store data when there is no other way in which to achieve the same purpose.
  • The more privacy-sensitive the information about you is, the less use we make of the data.
  • We use the data only in so far as there is a legally supported basis for that use.
  • We take suitable security measure against loss of personal data or unauthorised access to it.
